TERMS OF REFERENCE
Portfolio Committee on Public Service, Labour and Social Welfare: Engagement of a Consultant to Analyze National Disability Policy Framework in Zimbabwe

The Government of Zimbabwe received a grant from the European Union (EU) and United Nations Development Programme (UNDP) to finance the fourth cycle of the Parliamentary Support Programme (PSP) for the Parliament of Zimbabwe (2019-2022). The PSP is based on the Parliament of Zimbabwe’s Institutional Strategic Plan (2018-2023) and comprises 3 project outcomes aiming to adopt an innovative approach to strengthening the Parliament of Zimbabwe’s Legislative, Oversight and People Representative roles. It emphasizes protecting human rights, promoting transparency, accountability and democratic governance as outlined in the Constitution. Some of the initiatives that the Project endeavors to accomplish are to have;
- Improved timely passing of laws
- Improved compliance and uptake of Parliamentary and Audit recommendations, and
- Increased participation of citizens in Parliamentary business.
To effectively implement the project, the Parliament of Zimbabwe requires the services of a suitably qualified Civil Society Organization (here in referred to as the Consultant) to assist the Portfolio Committee on Public Service, Labour and Social Welfare with research, development of policy briefs and training and capacity building focusing on the following:
- Disabled Persons Act [Chapter 17:01]
- National Disability Policy (2021)
- Criminal Law (Codification and Reform) Act [Chapter 9:23],
- Mental Health Act [Chapter 15:12],
Objectives of the Consultancy
The overall objective of the consultancy is to strengthen the legislative and oversight capacity of the Parliamentary Portfolio Committee on Public Service, Labour and Social Welfare on Zimbabwe’s National Disability Policy Framework through providing research and capacity building on the identified laws. The specific objectives are as follows;
- To assist the Parliamentary Portfolio Committee on Public Service, Labour and Social Welfare to identify legislative and policy gaps in the identified pieces of legislation.
- To aid in improving the oversight role of the Parliamentary Portfolio Committee on Public Service, Labour and Social Welfare on issues affecting persons with disability.
- To contribute to improved compliance and uptake of Parliamentary recommendations through proposal of recommendations that can be considered by the Committee.
Scope of Consultancy Work
The Consultant is expected to:
- Hold a briefing meeting with Parliament Staff and/or other relevant stakeholders and based on this consultation develop an Inception Report outlining the work plan and methodology.
- In line with agreed methodology, review all existing relevant documents (laws and policies) and identify strengths and weaknesses in the existing legislations
- Undertake Legal analysis on the following areas legal instruments and policies
- Disabled Persons Act [Chapter 17:01]
- National Disability Policy (2021)
- Criminal Law (Codification and Reform) Act [Chapter 9:23],
- Mental Health Act [Chapter 15:12],
- Develop 4 Policy Briefs from the research
- Facilitate an interactive unpacking training workshop of the policy briefs for the Committee.
Deliverables of the Consultancy
The consultancy is expected to deliver for this assignment as defined by the TORs the following;
- One Inception Report which shall serve as a record for agreed deliverables. The Inception report will provide information on the Consultant’s understanding of the terms of reference, methodology of carrying out assignment, work plan and implementation schedule.
- 4 Policy Briefs
- Presentations and handouts
- Training Facilitation
- Draft Report on undertaken activities. The report will contain a brief summary of the whole assignment and the training workshops.
- Final report incorporating any inputs/comments received from the Parliament of Zimbabwe and other stakeholders.
Duration of Assignment
The consultancy is expected to be conducted in 15 days.

Minimum Qualification and Capabilities Required
- The consultant should have at least a team member with a Masters of Law Degree or equivalent, with an ability to scrutinize laws;
- At least five years of verifiable relevant experience in the fields of disability, human rights and governance themes and how they relate to the Zimbabwean National Disability Policy Framework;
- Strong interest and experience in policy research, advocacy and knowledge generation of the National Disability Policy Framework;
- Understanding of disability issues and their impact on Persons with Disability; and
- Exceptional stakeholder engagement skills in a range of contexts and with actors from the private sector, government and civil society.
Application Requirements
- A detailed technical proposal indicating the proposed methodology, approach and work plan;
- A detailed profile and portfolio containing the organization’s experiences with samples of previous work
- Proposed timeline of delivery;
- Financial proposal based on the deliverables outlined in the TOR(s);
- Email addresses and phone numbers of three accessible referees familiar with the organization’s work.
