The Mid – Year Fiscal Policy Review Statement
- The Minister of Tourism and Hospitality Industry moved that: WHEREAS, section 327(2)(a) of the Constitution of Zimbabwe provides that any
international treaty which has been concluded or executed by or under the authority of
the President does not bind Zimbabwe until it has been approved by Parliament;
WHEREAS the Republic of Zimbabwe is a member of the United Nations World
Tourism Organisation (UNWTO) and party to the 1947 United Nations Convention on
the Privileges and Immunities of Specialised Agencies;
WHEREAS the Republic of Zimbabwe joined the UNWTO in 1981;
WHEREAS the Republic of Zimbabwe is desirous of ratifying the pending
Amendments to the UNWTO Statutes and Financing Rules;
WHEREAS the Republic of Zimbabwe is desirous of acceding to Annex XVIII of the
1947 Convention on Privileges and Immunities relating to UNWTO;
NOW THEREFORE, in terms of section 327(2)(a) of the Constitution of Zimbabwe,
this House resolves that the aforesaid Statutes and Financing Rules and Annex XVIII of
the 1947 Convention be and is hereby approved for ratification and accession respectively.

That this House:
NOTING that when setting out the legislative agenda during the official opening of the 3rd session of the 7th Parliament on July 14, 2010, His Excellency, the President, stated that the Media Practitioners Bill which would repeal part of the Access to
Information and Protection of Privacy Act which deals with the registration of journalists and privacy issues would be tabled in Parliament;
WORRIED that six years on, the Executive has not responded to the call;
FURTHER WORRIED that AIPPA is in violation of some provisions of the new Constitution in particular section 61 (1) (a), (b) and (c);
CONCERNED that by not tabling the Bill, the Executive is violating its crucial role of preparing and initiating legislation as provided for in Section 110 (3) (c) of the Constitution of Zimbabwe.
FURTHER CONCERNED that failure to table the Bill is an abrogation of constitutional responsibilities of the Executive as outlined under Section 110(3) (c).
NOW THEREFORE calls upon the Executive to urgently table the Bill to repeal the offending provisions of AIPPA.

That this House;
COGNISANT of the fact that the Head of State and Government and Commander in Chief of the Zimbabwe Defence Forces, President Robert Gabriel Mugabe has played a pivotal role in the establishment, development and welfare of the Zimbabwe Defence Forces;
AWARE of the fact that the Zimbabwe Security Services are a product of the armed liberation struggle;
ACKNOWLEDGING that the Zimbabwe Security Services are the vanguard of
the country’s peace, security and sovereignty;
NOTING that the Zimbabwe Security Services have maintained and contributed to peace both within and beyond the country’s boarders through their peace keeping missions;
ALARMED by the lack of appreciation of the role the Zimbabwe Security Services
played and continue to play in the socio – political and economic development of Zimbabwe and Africa from some quarters of the local and international community;
NOW THEREFORE, calls upon the heroic Zimbabwean people:
(a) To recognise the iconic role and visionary leadership of the Commander in Chief of the Zimbabwe Defence Forces, President Robert Gabriel Mugabe;
(b) To complement the efforts of the Zimbabwe Security Services in the socio- political and economic development of the country to improve the welfare of the Nation; and
- To uphold the spirit of National Unity, peace and development.

That this House:
NOTING THAT this is the month to commemorate the International Women’s day (8th March);
ALARMED THAT Violence Against Women (VAW) is on the increase;
WORRIED that women are the most affected by the climate change, energy and water shortages;
FURTHER WORRIED that the women are the most affected by and bear most the consequences of the economic and social challenges;
CONCERNED that the Ministry of Women Affairs, Gender and Community Development is not adequately financed;
FURTHER CONCERNED that the following ratified Regional and International Instruments and Protocols have not been domesticated:
- The Convention on the Elimination of all Forms of Discrimination
Against Women (CEDAW);
- The Protocol to the African Charter on Human and People’s Rights on
the Rights of Women in Africa (the Maputo Protocol);
(c) SADC Protocol on Gender and Development;
(d) International Covenant on Civil and Political rights; and
- International Covenant on Economic, Social and Cultural Rights.
NOW THEREFORE, calls upon the Executive to urgently domesticate the afore- stated Regional and International Instruments and Protocols.

That this House;
NOTING that it has been exactly one year since the disappearance of Itai Dzamara;
CONSIDERING that the Minister of Home Affairs was ordered to give monthly reports on progress;
PERTURBED that the Government has not been updating the Nation on progress;
COGNISANT of the citizen’s constitutional right and the importance of strengthening the constitutionalism, human rights and consolidation of democracy;
ACKNOWLEDGES the existence of the International Convention on the Protection from Enforced Disappearances as an international human rights instrument.
NOW THEREFORE, Parliament calls upon the Government to:
- Bring finality and closure to investigations leaving no stones unturned;
- Chip in on the social welfare and support to the Dzamara family, particularly
the wife and children as restorative and rehabilitative measures;
(c) Guarantee non repetition of such occurrences and giving assurance in the
protection to the right to demonstrate and petition; and
(d) Ensure all perpetrators of politically motivated violence are prosecuted and that
victims receive restorative and rehabilitative justice.

That this House:
DEVASTATED by the clear and evident failure and dereliction of duty by the Ministry of Mines and Mining Development to effectively exercise ownership rights vested in the government’s majority stake in Hwange Colliery Company Limited,
COMPLETELY WORRIED that this has led to the precipitous and absolute collapse of the Hwange Colliery Company Limited;
NOW THEREFORE, calls upon the Executive, in liaison with fellow shareholders of Hwange Colliery Company Limited;
To pay, with immediate effect, each and every employee of the company all his or her wages, wages of which have been unpaid and remain outstanding for 30 or so consecutive months
Institute a thorough forensic audit of the company’s affairs and prosecute individually or jointly and severally all the company officials liable for wrong doing.
Urgently take emergency measures to rescue the company from imminent winding up as a failed corporation by putting in place an effective management team and board of directors.
Serious consider setting up a professional body to manage investment of public funds in corporations like Hwange Colliery Company, instead of leaving such responsibility to fortuitous ministerial appointees.

That this House takes note of the Report of the Zimbabwe delegation to the Fourth International Parliamentary Forum on the Role of Parliaments in Ensuring International Security in Contemporary Conditions, held in Moscow, Russia on the 1st October 2015 and the Sixth Global Conference of Parliamentarians Against Corruption held in Yogyakarta, Indonesia, from 6th to 8th October 2015.

That this House -
RECALLING THAT on 5 February 2014 I moved a motion for stiff mandatory sentences for rape and other gender based violence crimes, scientific investigation of rape and the implementation of the National Gender Based Violence Strategy.
DISMAYED that only the Ministers of Justice, Legal and Parliamentary Affairs and Women Affairs, Gender and Community Development responded to the motion, while the Ministers of 1) Health and Child Care, 2) Home Affairs, 3) Finance and Economic Development and 4) Higher and Tertiary Education, Science and Technology Development did not respond to the motion, causing me to move to re-instate it on the Order Paper upon its lapse with the prorogation of 2 sessions.
NOTING THAT the 16 days of activism against gender based violence began on 25 November and ended on 10 December 2015, the International Human Rights Day whose theme was ‘From Peace in the Home to Peace in the World: Make Education safe for all’;
STILL DISTURBED by the high rate of gender based violence in Zimbabwe, i.e. against women and girls who have been raped from 2013-2015;
STILL CONCERNED by the low rate of apprehension, conviction and sentencing of perpetrators of gender based violence;
STILL CONCERNED by the absence and lack of crime forensic experts in Zimbabwe, as well as the lack of forensic rape investigation kits;
COGNISANT that at the launch of the 16 days of activism campaign of 2012 government launched the National Gender Based Violence Strategy 2012-2015 whose four key result areas are Prevention, Service Provision, Research, Documentation, Evaluation and Coordination;
Now therefore resolve that;
- There be legislated a mandatory sentence for rape, including statutory rape, of not less than thirty years and appropriate sentences for other forms of gender based violence.
- The government immediately engages adequate services of forensic scientists for purposes of investigating rape.
- The government immediately and continually equip all police stations with forensic investigation rape kits.
- The government immediately implements with stakeholders the “Zimbabwe National Gender Based Violence Strategy: 2012-2015".

That this House -
NOTING with concern that at least 10 percent of the 13 million Zimbabweans have some form of disability;
CONCERNED that despite various awareness programmes initiated by both the
Government and non-governmental organisations, people living with disabilities are
still subject to stigma and discrimination;
FURTHER CONCERNED that there's no institutionalised deliberate inclusion strategy
from primary education to tertiary level to support students with disabilities.
ACKNOWLEDGING the various initiatives taken by Government in post-
independence Zimbabwe to empower and improve the lot of people living with
disabilities such as the introduction of vocational training centres for people living with
disabilities and the enactment of the Disabled Persons Act in 1992;
RECOGNISING the tax concessions extended to people living with disabilities such as
the suspension of Customs Duty on certain specified motor vehicles imported by
physically handicapped persons for their own use.
DISTURBED that such noble concessions do not extend to critical equipment such as
wheelchairs, hearing aids, braille and crutches for use by people living with disabilities;
WORRIED that as a result of the taxes levied on wheelchairs, braille and crutches they
are beyond the reach of the majority of people living with disabilities who are poor;
FURTHER WORRIED that sign language which caters for the deaf and dumb and
Braille for the blind has not been allowed to take root from primary education level for
no fee in line with section 75 of the constitution calling for education for all.
NOW, THEREFORE, CALLS UPON THE GOVERNMENT TO:
- Introduce tax concessions starting from the 2017 Budget for critical equipment such as wheelchairs, braille and crutches to ensure that they are affordable to the majority of people living with disabilities;
- Make sign language and Braille all inclusive and compulsory for all institutions of learning to provide, a well-rounded education system for people living with disabilities and needing such learning and education.
- Urgently Harmonize our laws in line with the United Nations Conventions of Persons Living with Disabilities and the new Constitution to improve the lives of the affected disabled persons; and,
- Increase the allocation for disability services in the national budget to cover the essential basic needs for all disabled people in Zimbabwe.

That this House –
COGNISANT of the state of the Zimbabwe economy particularly foreign direct investment and liquidity challenges;
ACKNOWLEDGING the role of state enterprises and parastatal in the development of our economy;
APPALLED by the cases of mismanagement and corruption in these organisations;
NOTING the absence of corporate governance in our parastatals and state enterprises;
CONCERNED with the extent of political interference in these organization;
ACKNOWLEDGING the incapacity of Auditor General, law enforcement agents and Anti -
Corruption Commission in dealing with corrupt cases in these organisations;
NOW, THEREFORE, this House resolves that:
- The National Code on Corporate Governance be enforced in all parastatals and state enterprises.
- Appointments to Parastatal Boards be made on the basis of merit, competency and professionalism.
- Measures be taken to expose, combat and eradicate corruption in state enterprises and parastatals.

That this House -
ACKNOWLEDGING that Section 18 of the Constitution provides for regional equality and states “The state must promote the fair representation of all Zimbabwe’s regions in all institutions and agencies of government at every level;
FURTHER ACKNOWLEDGING that Section 17 provides that “The State must promote full gender balance in Zimbabwean society, and in particular the state must promote the full participation of women in all spheres of Zimbabwean society on the basis of equality with men;
NOTING that both Section 18 and Section 17 place obligations on the state to take specific measures to rectify both regional and gender imbalances in society;
CONCERNED that the process of identifying providers of government services and government tenders are violating Section 17 and Section 18;
NOW THEREFORE resolves to call upon the Executive to ensure that:
- All processes of identifying providers of services to government are conducted in a transparent and accountable manner.
- Awarding of government and parastatal tenders promotes fair regional representation; and
- A 30% quota of all government tenders are reserved for women.

That this House takes note of the Report of the 134th Assembly of the Inter – Parliamentary Union (IPU) held in Lusaka, Zambia, 19 to 26 March 2016.

That this House:
NOTING the disturbing images and video footage of men and women in police uniform beating up innocent civilians
AWARE that the Police Charter rests on the settled principle of pro lege, pro patria, pro populi (for the law, for the country, for the people)
WORRIED by the recent behavior and conduct of certain Police details in their handling and beating up of demonstrating and peace loving citizens.
CONCERNED with human rights abuses and rule by law instead rule of law, as instigated by certain police officers or persons masquerading as Police;
PERTUBED that the Minister responsible for the Police or the Commissioner General have not made efforts to censure or discipline the perpetrators who violated the National Constitution.
FURTHER CONCERNED that the bad behavior of a few bad apples among the Police are creating animosity between citizens (people of Zimbabwe) and the Police
ACKNOWLEDGING that His Excellency President Mugabe has publicly condemned the public who were exercising their rights without correspondingly condemning the Police for their abuse of citizen rights and that of the Constitution
NOW THEREFORE, calls upon the Minister of Home Affairs to :
- Investigate the conduct of the Police and report to the Parliament
- Issue a public apology over the untoward conduct of some of the Police Officers
- Immediately implement a training of Police on human rights as part of their curriculum in terms of the Constitution.
- Put in place an act of Parliament setting up an Independent Complaints Mechanism for members of the public as contemplated by Section 210 of the National Constitution; and
That Parliament sets up a Commission of Inquiry to investigate into the conduct of such officers.

FURTHER worried that the cash shortages are inconveniencing, general members of the public including firms;

(a) De – dollarize and adopt the rand as the anchor currency; and
(b) Address the fundamental structural causes of the financial and economic crisis

NOTING that children's rights are adequately covered in the New Constitution and include inter alia-
(a) the right to a name; and
(b) The right to the prompt provision of a birth certificate.
CONCERNED that children face a plethora of problems, in particular those with single parents or who have lost both parents, in accessing the relevant documents.
FURTHER CONCERNED that children face a multitude of difficulties, particularly the girl child, which include sexual abuse and exploitation.
WORRIED that these issues have not received adequate remedial measures.
NOW THEREFORE this House calls upon the relevant Ministries to put in place:
- appropriate mechanisms to resolve the problems faced by children and, in particular, to synchronise the issuance of identity documents at all health centres by the Ministry of Home Affairs, at the time of birth; and
- measures to address issues of sexual abuse and exploitation of children as matter of urgency - D.S. Sibanda .

Question proposed: That this House;
COGNISANT that due to the prevailing economic challenges and high levels of unemployment the vast majority of Zimbabweans have very limited disposable income;
AWARE that Section 76 of the Constitution makes access to health care a fundamental and inalienable right of every Zimbabwean and obliges the State to ensure that no person is refused emergency medical treatment in any health-care institution;
ALARMED at the prohibitive cost of blood in both public and private hospitals with a pint going for USD 140 on average which has made access to blood a preserve of the rich;
CONCERNED that the majority of Zimbabweans who require blood transfusions, particularly in district hospitals and clinics, are succumbing to avoidable deaths owing to their inability to afford blood;
FURTHER CONCERNED that though emergency medical treatment is a fundamental human right, health institutions are refusing to give needy patients’ blood without prior payment yet the cost is beyond the reach of many;
DISTRESSED that blood transfusion in district hospitals and clinics is only available for expecting mothers and is not extended to victims of accidents and trauma who account for 35% of the national blood requirements;
MINDFUL that blood distribution by the National Blood Service Zimbabwe in 2014 marginally increased by 0.7% primarily due to depressed demand owing to the harsh economic conditions;
DISTURBED that the price of blood in Zimbabwe does not compare favourably with the price of blood regionally;
NOW THEREFORE, call upon the Executive to:
(a) Subsidize the cost of blood to save lives by ensuring that it is available for all needy patients at private and public hospitals;
(b) To de-centralise the blood bank by establishing a blood bank at all district hospitals and clinics;
(c) To raise awareness on the importance of donating blood particularly among adults who account for only 20% of the national blood donations yet use 80% of the blood so donated- Hon. Nduna.

DISTURBED by the increase in cases of human trafficking in Zimbabwe, particularly girls and young women;
ALARMED by the recent case of over 150 women who were reportedly stranded in Kuwait after they were lured to that country by a syndicate of human traffickers, on the pretext that they would get lucrative jobs;
NOW, THEREFORE, this House resolves that:
- Government expedites investigations by the Inter-Ministerial Committee and
ensure urgent repatriation of all the women who are currently stranded in Kuwait under slavery conditions;
(b) Perpetrators of these heinous acts must face the full wrath of the law;
- The Ministry of Home Affairs must urgently conduct awareness programmes on
human trafficking and educate the unsuspecting public, especially the youth about the dangers of human trafficking.
- That the Ministry of Foreign Affairs should urgently write to the Kuwait
Foreign Affairs Ministry requesting Kuwait authorities to ban the issue of Article 20 Visas which allows Kuwait employers to hire Zimbabwean citizens under slave conditions.
- That the Zimbabwean Embassy in Kuwait be allocated urgently sufficient
financial resources to take care of the feeding and repatriation of the affected young ladies - Hon. Nyamupinga.

To add after sub – paragraph (e) the following sub paragraphs-
(f) The government must urgently develop a comprehensive National Strategy and fight human trafficking; and
(g) The government must also establish a Compensation Fund for all victims of human trafficking.
