ANNOUNCEMENTS BY MADAM PRESIDENT

DEATH OF HON. JOSEPH MSIKA AND HON. RICHARD HOVE

MADAM PRESIDENT: I have to inform hon. senators of the death of Hon. Vice President Joseph Msika on Wednesday 15th August 2009 and that of Hon. Senator Richard Hove on Sunday 21st August 2009. May I invite hon. Senators to rise and observe a moment of silence.

All senators rose and observed a moment of silence.

ERROR ON THE ORDER PAPER

MADAM PRESIDENT: I have to attract the attention of hon. senators to an error on today's Order Paper, the date of the question for Oral Answers are misplaced. Note, today's date is Tuesday the 1st September, 2009, questions for Oral Answers should appear on Thursday 3rd September, 2009. The error is sincerely regretted.

CHANGES TO COMMITTEE MEMBERSHIP

MADAM PRESIDENT: I also have to announce that due to clashes in the sitting occasions, the following senators have been transferred to the following committee.

Senator Komichi will sit on Indigenisation and Empowerment and the second will be HIV and AIDS.

Senator Makore, will sit on the Human Rights and the second Committee will be Gender and Development Committee.

MADAM PRESIDENT: I have to inform hon. senators to switch off their cellphones.

MOTION

RATIFICATION OF THE SADC PROTOCOL ON FINANCE AND INVESTMENT

THE MINISTER OF ECONOMIC PLANNING AND INVESTMENT PROMOTION : Madam President, I move the motion

THAT WHEREAS subsection (1) of Section 111B of the Constitution of Zimbabwe provides that any convention, treaty or agreement acceded to, concluded or executed by or under the authority of the President with one or more foreign States or Governments or international organizations shall be subject to approval by Parliament;

AND WHEREAS the SADC Protocol on Finance and Investment was signed by His Excellency the President on 18 August, 2006, at Maseru, Lesotho;

AND WHEREAS the entry into force of the aforesaid Ðrotocol is subject to ratification by the signatory Member States in accordance wi|h their respectivѥ constitutional procedures;

NOW, THEREFORE, in terms of subsection (1) of section 111B of the Constitution, this ouse resolves that the aforesaid Protocol be and ic hereby apprmved for ratificaɴion.

I come here, not asဠMinister of Finance, but on my correct Portfolio of(Ecmnomiţ Planning ajd 䁉nvestment ⁐⁲omotion. эAdam Presideɮt, én ࡴermó or Sectmon 31 H4b of Ŵhe Cons䁴itutIon of Zimbabwe, His Excellency, the President of Zimbabwe may enter into international conventions and treaties. Zimbabwe consequently signed to the SADC Protocol on Investment, the objectives of the said Protocol are to foster harmony with other nations in order to make them consider the objectives of SADC.

Any changes in one member state do not necessitate adjustments in other member states in the SADC region as a common investment area. Article 2 provides that it shall be subject to ratification by the state. It is desirable that the government of Zimbabwe ratifies this. I accordingly move that this House approves this as required by Section 11(b) of the Constitution.
