5. Adjourned debate on motion on State action in respect of Operation Muarambatsvina (adjourned 28^th June - The Minister of Justice, Legal and Parliamentary Affairs).

CONCERNED with the massive destruction of people’s homes, markets and livelihoods under the vehicle of the so-called Operation Murambatsvina;

 

DISTURBED AND SHOCKED at the abuse of the rule of law, breach of the Constitution, international standards on the right to housing, the right to life, the rights of the children and the rights against forced evictions;

 

SHOCKED by the callousness of the State actions, particularly in the context of the current economic crisis, the ravaging winter and the massive food shortage;

 

DISMAYED at the total abuse of the local authorities and disrespect of the Urban Councils Act (Chapter 29:15) and the Regional Town and Country Planning Act (Chapter 29:12).

 

CONDEMNS AND CENSORS in the strongest of terms the State actions in respect of Operation Murambatsvina;

 

CALLS on Government to immediately stop and cease the aforesaid operation;

 

RESOLVES that Government abide by the international standards, the constitution and generally the rule of law;

 

CALLS on Government to comprehensively address the issue of national housing and in general terms the current structural economic crises;

 

CALLS on Government to urgently provide basic amenities and decent living standards to the victims of the current operation- Mr Mushoriwa

TAKING NOTE of the massive food, drugs, foreign currency and energy shortages;

 

CONCERNED with the continued unabated collapse of the public amenities in health, transport and education;

 

DISMAYED at the lack of any concrete, meaningful and decisive reversal programme by government;

 

DISTURBED by the shrinking economy and failing state particularly in areas of service provision;

 

RESOLVES that the government immediately addresses the critical shortages of shortages of food energy and public sector amenities;

 

CONDEMNS the absence of existing comprehensive monetary and fiscal reversal strategy;

 

FURTHER CONDEMNS the clear lack of strategy and leadership on the part of this Government.

1. MRS L. G. B. STEVENSON:     To ask the Minister of Local Government, Public Works and National Housing to:

 

1. provide the House with the minutes of the meeting held by the Commission running Harare during which it resolved to implement “Operation

Murambatsvina”;

 

1. explain why alternative housing factory shells and market stalls were not constructed before destroying people’s homes and livelihoods;

 

1. explain why vendors with valid licences trading at authorized market places erected by the City of Harare using ratepayers’ money were arrested and their goods confiscated;
2. inform the House the number of people who have been removed from their socalled illegal houses and where those people are now living;

 

1. inform the House whether stands at Hatcliffe Extension site-and-service scheme funded by the World Bank will be reallocated, the criteria that would be used for selection of the new beneficiaries, or whether the scheme would be used for a purpose other than low-cost housing.

2. PROF. J. MOYO: To ask the Minister of Finance to furnish the House with the exact information on:
3. How many African and non African countries voted for or against Dr. Simba Makoni at the recent inconclusive elections in Lagos, Nigeria, for the next president of the Africa Development Bank (ADB);
4. The voting process, outlining which countries voted and indicating the actual vote in percentage terms in the respective rounds;

• What lessons the Government of Zimbabwe has drawn from this experience;

3. MR CHEBUNDO: To ask the Minister of Finance what will become of the $5 billion taxpayers money reportedly given to the Homestake Gold Mining Company in KweKwe  by the Reserve Bank of Zimbabwe last year under the Productive Sector Facility.

4. HON. L MOYO: To ask the Minister of Finance to comment on:
5. whether it is the function of the Governor of the Reserve Bank of Zimbabwe to make policy pronouncements, promising and allocating funds to various business sectors and other institutions;
6. whether the Ministry of Finance sanctions these disbursements and if so to elaborate on the selection process;
7. whether it is proper for the Central Bank to compete with the Commercial

Banks and other financial institutions; and

1. whether are there any mechanism to ensure transparency and create checks and balances in order to ensure maximum accountability.

 

5. HON SIKHALA: To ask the Minister of Finance whether the Reserve Bank of Zimbabwe will be able to recover the $3 trillion which was disbursed under the Productive Sector Facility.

 

6. HON. SIKHALA: To ask the Minister of Finance to explain whether   the Reserve Bank of Zimbabwe is legally entitled to perform functions of Commercial Banks in Zimbabwe.

 

7. HON. SIKHALA: To ask the Minister of Finance to explain to this House the checks and balances have been put in place to protect the nation against abuse of funds advanced to parastatals and municipalities by the Reserve Bank of Zimbabwe.
8. PROF. MOYO: To ask the Minister of Information and Publicity whether it is true as reported in the media that:
9. i) In May 2005 the ZANU PF Secretary for Information and Publicity, Dr. Nathan Shamuyarira, visited Zimbabwe Broadcasting Holdings (ZBH) premises at Pockets Hill accompanied by the Ambassador of the Islamic

Republic of Iran to Zimbabwe, with no representation from the

Government of Zimbabwe; ii)  Dr. Shamuyarira addressed ZBH management and staff at a closed meeting on a range of unspecified issues in the absence of the

Broadcasting Authority of Zimbabwe; and iii)    If the above allegations are correct and whether the minister is aware of what issues Dr. Shamuyarira discussed with management and staff of the national public broadcaster and in what capacity given that Dr. Shamuyarira is not a member or official of the Government of Zimbabwe but a functionary of a political party.

9. HON. CHEBUNDO: To ask the Minister of Mines and Mining Development to explain measures being taken by his ministry to address the problems surrounding the Homestake Gold Mining Company in Kwekwe Viz:
10. the alleged abandonment of the mines by the owner and the alleged clandestine disposal of the mines and assets without the knowledge of the creditors and workers to ensure that workers and other creditors are not left out in the cold;
11. what came out of the efforts of the former minister and ministry officials who worked closely and reportedly still showing interest in the mines;
12. the welfare of the more than 650 employees who have not been paid their salaries for the past 8 months and the reported non remittance of the pension contributions to the Mines Pension Fund; and
13. reported rampant illegal and uncontrolled panning on underground safety pillars taking place under cover of darkness thereby posing danger of collapsing of sections of the city.

10. HON. SIKHALA: To ask the Minister of Justice, Legal and Parliamentary Affairs whether he is aware that the State Indebted Insolvent Companies Act breaches the constitutional provision on property rights, and if so what corrective measures he intends to take, especially in light of the fate if Shabanie-Mashava Mines.

 

11. HON. SIKHALA: To ask the Minister of Justice, Legal and Parliamentary

Affairs to enlighten the House on the source of the Productive Sector Investment Facility, and to name the accounting organs/institutions of those funds.

 

12. HON. SIKHALA: To ask the Minister of Justice, Legal and Parliamentary

Affairs to comment on the Executive’s involvement in the administration of private companies in the name of national interests without resorting to the courts as provided for in our bankruptcy laws, citing the case of  Shabanie-Mashava Mines.

 

13. HON. SIKHALA: To ask the Minister of Justice, Legal and Parliamentary Affairs to clarify the steps involved in the specification of companies, explaining how companies are placed under state- appointed administrators.

 

14. HON. SIKHALA: To ask the Minister Industry and International Trade to provide statistics on foreign investment, given that Zimbabwe is under spot light against a background of international concern about the rule of law and property rights.

 

15. HON. SIKHALA: To ask the Minister of State for Indigenisation and

Empowerment to define the ministries’ policy on indigenisation particularly in light of the recent takeover of assets owned by black individuals through state instruments like what happened to Mutumwa Mawere, James Makamba  and Jefrey Munzwimbi etc.

 

16. HON. SIKHALA: To ask the Minister of State Enterprises, Anti-Monopolies and Anti Corruption to:
17. inform this august House on the  process used in the appointment of  Mr A.
18. Gwaradzimba as the administrator of SMMH; ii. furnish this House with Mr Aafarus.M. Gwaradzimba’s remuneration package; and

iii.     Confirm if SMMH funds were used to finance the Tsholotsholo gathering in late 2004.

 

17. HON. SIKHALA:To ask the Minister of State Enterprises, Anti-Monopolies and Anti Corruption to enlighten this House on the indebtedness of SMMH since the appointment of an administrator and to provide a breakdown of application of the funds.

 

18. HON. SIKHALA: To ask the Minister Mines and Mining Development to inform the House on why a South African based company owned by a Jewish family, J. G. Petrow has been given the exclusive rights to market our asbestos when the Minerals Marketing Corporation of Zimbabwe is responsible for the marketing all minerals.

 

19. HON. CHIMBAIRA: To ask the Minister of Local Government, Public Works and Urban Development what form of assistance will be given, if any and when to the owners of at least 40 houses destroyed in Unit E and H in Zengeza Constituency.

 

20. HON. CHIMBAIRA: To ask the Minister of Local Government, Public Works andUrban Development to inform the House why dwellings were demolished on the piece of land currently occupied by the Apostolic Sect in Units E and H which was bought by the South African Government in 1960 for the Apostolic Sect members, yet these structures have been there since 1962.

 

21. HON. GWETU: To ask the Minister of Local Government, Public Works and Urban Development to confirm allegations that if members of the community do not pull down their structures, they will be subjected to paying fines of not less than half a million dollars per each structure.

 

22. HON. CHAMISA: To ask the Minister of Local Government, Public Works and Urban Development to explain:
    1. why the Kuwadzana Library has not been completed for so long since the local community is precariously starved of library services; and
    2. why the Harare City Council is reluctant to accept the donation for the Library that was raised by the local MP.

 

23. HON. CHAMISA: To ask the Minister of Local Government, Public Works and, Urban Development to inform the House:
24. what the Ministry intends to do to alleviate the plight of residents of Kuwadzana Extension who do not have facilities such as shops, tower lights and standard roads, particularly after operation Murambatsvina which destroyed the tuck shops;
25. why it has taken a long time for Kuwadzana Extension to be officially handed over to the local city council by the Government and when this handover is expected.

 

24. HON. CHAMISA: To ask the Minister of Youth Development and Employment Creation to:
    1. explain whether the youth training programmes are to be continued and, if so, where the Government will get the resources for the expansion, considering that the programme nearly collapsed due to lack of resources; and
    2. outline the benefits of the national youth training service to the nation and provide statistics of the number of youths per province that have benefited from the programme.

 

25. HON. GWETU: To ask the Minister of State Water Resources and Infrastructural Development to report to this august House the progress on the Zambezi Water Project particularly the Gwayi/Shangani phase.

 

26. HON. MUSA: To ask the Minister of State Water Resources and Infrastructural Development when Chipara Dam on the Mudzi river is going to be constructed.

 

27. HON. CHAMISA: To ask the Minister of Home Affairs to update this House on the progress made so far regarding the construction of Kuwadzana Police Station.

 

28. HON. L MOYO: To ask the Minister of Transport and Communication to:
    1. confirm whether the newly purchased Chinese made Air Zimbabwe

passenger plane is safe to travel on;

1. explain why the construction of the portion of Kezi-Bulawayo road is done without adequate road construction signs as the current situation endangers the lives of road users and whether the ministry is considering widening of the existing narrow bridges;
2. state when the tarring of Kezi-Bulawayo road would be completed;
3. explain when the construction of Maphisa-Gwanda road would begin; and
4. provide a breakdown of the funds that were borrowed for the construction of Maphisa-Gwanda road.

 

29. HON. MUSA: To ask the Minister Transport and Communication when

Mtoko-Rwenya road is going to be surfaced and why it has taken so long.

 

30. HON. MUSA: To ask the Minister Transport and Communication why Rewenya-Nyamapanda has been maintained for same time.
