  1. The President of the Senate advised Members of the Association of Zimbabwe Parliamentarians Against HIV that there would be a meeting on Thursday, 8th December 2016, at 0900 hours in the Government Caucus Room. Senators were also advised that those interested in issues pertaining to HIV and AIDS were invited.

  1. The Minister of Finance and Economic Development, moved: THAT WHEREAS,

Subsection (3) of Section 327 of the Constitution of Zimbabwe provides that an Agreement which is not an international treaty but which has been concluded or executed by the President or under the President’s authority with one or more foreign organizations or entities and imposes fiscal obligations on Zimbabwe does not bind Zimbabwe until it has been approved by Parliament;

 

AND WHEREAS, the Loan Agreement between Government of Zimbabwe and

Export-Import Bank of China relating to Hwange 7 and 8 Thermal Power Expansion Project being implemented by Hwange Electricity Supply Company Pvt. Ltd was concluded on the 30 June 2016 in Harare, Zimbabwe; and

 

NOW THEREFORE, in terms of section 327(3) of the Constitution, this House resolves that the aforesaid Agreement be and is hereby approved.

            Motion put and agreed to.

  1. The Minister of Finance and Economic Development, moved: THAT WHEREAS, Subsection (2) of Section 327 of the Constitution of Zimbabwe provides that an international treaty which has been concluded or executed by the President or under the President’s authority does not bind Zimbabwe until it has been approved by

Parliament and does not form part of the law of Zimbabwe unless it has been incorporated into law through an Act of Parliament;

 

AND WHEREAS, an Agreement for the establishment of the African Legal Support Facility, an affiliate of the African Development Bank (AfDB) that provides legal technical assistance in the negotiation of contracts and creates synergies between the private sector and African countries, was signed on 14 October 2008;

 

NOW THEREFORE, in terms of section 327(2) of the Constitution, this House resolves that the aforesaid Agreement be and is hereby approved.

            Motion put and agreed to.

  1. Adjourned debate on motion on the Report of the delegation to the 68th Session of the Executive Committee of the African Parliamentary Union (Adjourned 6th December, 2016 – The Minister of Defence).

*1. HON. SEN. MLOTSHWA: To ask the Minister of Lands and Rural Resettlement to inform the House why government is violently evicting communities from farming and grazing lands in the Zvehamba, Matankeni, Mahetshe villages of Matobo District

at the behest of Trek/ARDA Project which is enforcing a 1947 plan, which does not recognize that these families have been residing in these areas since 1912.

*2. HON. SEN. SIBANDA B: To ask the Minister of Finance and Economic Development to provide the House with detailed figures as at 30 September, 2016 of:

  1. The comprehensive foreign debt inclusive of interest accrued;
  2. Domestic loans debt and who these are owed to;
  3. Parastals debts that government has committed to take over;
  4. Individuals and or company debts covered by ZAMCO to date;
  5. Treasury Bills commitments including any that may have been rolled over; and
  6. Any other debt owed by government not covered by these specified above.

*3. HON. SEN. SIBANDA B: To ask the Minister of Environment, Water and Climate to advise the house whether the Ministry has:

  1. Developed a water resources development strategic plan for the country in view of dwindling water levels and what timeframes have been specified for the development of extra water capacity for the main cities; and
  2. What concrete plans, if any, are in place for the construction of the Zambezi Water Project.

      That this House conveys its profound gratitude to His Excellency, the President Cde.        R. G. Mugabe for addressing a joint sitting of Parliament on the State of the Nation.

Expresses its commitment to and support for the views contained in his address; and that a respectful address be presented to His Excellency the President, informing him

       of the sentiments of the House.

2.         HON. SEN. MOHADI HON. SEN. CHIPANGA

That this House:

MINDFUL that the SADC Model Law is a milestone in eradicating the matrimony of the children and also in protecting those who are already in marriage;

APPRECIATIVE that the Model Law embraces all concepts on the prohibition of child marriages as adopted in Swaziland in 2016;

DESIROUS to see the end to child marriages as well as any retrogressive measures and hurdles that mitigate against the eradication of such unions;

NOW, THERFORE calls upon Government to domesticate provisions of the Model Law as part of our statutes.

THAT WHEREAS , Subsection (2) (a) of Section 327 of the Constitution of Zimbabwe provides that an international treaty which has been concluded or executed by the President or under the President’s authority does not bind Zimbabwe until it has been approved by Parliament;

AND WHEREAS, an Agreement of the Global Fund between the Government of Zimbabwe and the Global Fund relating to Privileges and Immunities was concluded on the 30th day of September 2015 in Harare, Zimbabwe and;

NOW THEREFORE, in terms of Section 327 (3) of the Constitution, this House resolves that the aforesaid Agreement be and is hereby approved.
